Abstract

In the era of “we media”, with the extreme subsidence of Internet discourse power, with the extreme subsidence of Internet discourse power, numerous false information was provided on the Internet and other media; therefore, it is necessary to prevent this by legally confirming the right to respond. The right of response system has the functions of self-protection, prevention of damage, timely resolution of disputes, and protection of public access to real information, etc. In nature, the right of response is a part of the right of personality claim, which is the embodiment of Article 995 of the Civil Code on the right to request to eliminate obstacles and eliminate influences. With its own unique conditions for the exercise, the basic principle of the exercise of the right of response is to equally protect non-patrimonial rights and respond when information is released. Although the Civil Code does not explicitly stipulate the right of response, it can be explained through relevant provisions that the Civil Code has recognized the system.
